Booking Conditions

1.0 The Contract

1.1 These Conditions govern all bookings made by you – the ‘Customer’ and The Spot Surf Morocco S.A.R.L. – the ‘Company’.

1.2 Any cancellations or changes to your booking must be made in writing. Refund or deposits for cancellations are as follows:

4 weeks or more from holiday commencement date = full refund
2-3 weeks before course start date = 50% refund
Less than 2 weeks to course start date = no refund.

If the booking is changed more than 21 days prior to the holiday, every effort will be made to effect the change. No changes can be made at less than 21 days prior to commencement of holidays except at our absolute discretion.

1.3 A contract will exist between us when your Booking is confirmed in writing or email. All contracts are subject to the laws of Morocco, and any disputes will be subject to the jurisdiction of the Moroccan Courts.


2.0 The Price and Payment

2.1 The price of the holiday will be the amount shown on the Booking form.

2.2 All prices are quoted in GBP and are payable as follows: 50 % with booking, with the remainder payable 2 weeks prior to the holiday commencing. If the holiday is booked less than 6 weeks before it is due to commence, the entire price is payable at the time of booking.

2.3 Once a booking is confirmed by us the price of the holiday will not change unless due to variations in service charges, insurance or exchange rates. If the proposed change is greater than 10% of the total booking price, you will be given an opportunity of cancelling the holiday with a full refund.


3.0 The Holiday

3.1 You accept that participation in any surfing or related activities is at your sole risk and you are strongly advised to take out personal insurance to cover any accidents or damages occurring whilst on holiday, required medical treatment or any loss or damage to personal belongings.

3.2 You must declare in writing any medical conditions which may affect you whilst on holiday and you must satisfy yourself, taking medical advice if appropriate, that you have no conditions or ailment which make it ill advised to surf


4.0 Our Liability

4.1 We accept no liability to you for personal injury, or for any loss, or damage whatsoever unless directly caused by our negligence or that of our employees.

4.2 Our surf guides are guides and not qualified instructors. They will take you to surf areas and suggest where to surf but are not responsible to you for injury or death whilst surfing.

4.3 In no event will the aggregate liability of the company exceed the price of the booked holiday.


5.0 Your Obligations

5.1 You will make good any loss or damage caused to company equipment otherwise than by fair wear and tear.

5.2 You agree to strictly adhere to any instructions issued by us in the course of any surfing courses or activities and you agree to abide by any decision of local instructors or company.

5.3 You are expected to behave in an orderly and acceptable manner during any surfing activities. If your behaviour threaten the condition of the accommodation or safety or other holiday makers, we reserves the right to terminate the holiday without any liability to your representatives.


6.0 Personal Data Security

6.1 Personal details will not be passed to any third party without your explicit permission or other than to the extent necessary to facilitate your booking/holiday.


7.0 Legal Stuff

7.1 Neither of us will have any responsibility to the other for any failure to perform its obligations under the contract where such performance is prevented by factors outside the reasonable control of the affected party.

7.2 Communications in connection with the booking are deemed effective when sent by email to the Customer’s email address notified to the Company by the Customer.
